generally speaking, for any program:
- If you have access to the code there should be a license that will describe your rights.
- There is nothing stopping you trying to recreate the game for your own usage, but there may be limitations on publishing what you do.
- Note that there is also possible copyright on any artwork.

I guess a generic 2D shooter is fine, but if you feel that what you do is plagiarism, it probably is!
In which case, at least it is polite to acknowledge/mention where your inspiration comes from.
