I agree that it should not be selected as CotD but I do not share your opinion that this code is "stolen". Author gave credit to the original source and didn't break the rules saying that he has created the code himself, so I'm not going to report this code.

You're right! but he said he saw it on the web at the bottom of the HTML part of the code.

^The guy that posted the COTD here gave credit to the original coder and informed that it was posted code. He did what a good coder is suppose to do when you borrow code.

However, as you guys implied, he shouldn't be given COTD for code that he didn't write, despite that he credited the author.
