Games or softwares usually came with a user agreement notice, read it carefully to understand whether or not your ported version is considered a copyright violation.

Copied code is something which you totally copied and nothing is yours at least something should be from one's side.
But yeah if you have taken someone's code then don't forget to give credits to the original one.
As ehen you 'll give credits to the original code and implement the code. It will not be called a "copied code"
